How unruly students will be punished

Schools will not be allowed to withdraw the candidature of a student from national examinations as a form of punishment, the 2014 basic education regulations propose.

The regulations also bar schools from coming up with rules that contravene the provisions of the Constitution, Basic Education Act and the Children’s Act.

Schools and other basic education institutions will be required to implement only those disciplinary measures approved by the county education board.

A learner shall be deemed to be individually indisciplined if he or she is involved in physical fights, bullying of other learners and stealing, the rules say.

LAW INSTRUCTIONS

“Learners involved in exams cheating, abuse of teachers and other persons in authority, become defiant to lawful instructions and engage in drug trafficking or substance abuse will be considered indisciplined,” the new rules add.

Schools will be required to establish and keep a register of the name, class, offence committed, date, warnings or any other corrective measures taken against a learner in matters of discipline.

The parent of an indisciplined learner will be summoned to appear before the board of management committee on discipline and ethics within 10 days. Recommendations of the board shall, within two days, be communicated to the county director of education.

The learner could be transferred to a corrective centre or to an institution of basic education and training secured by a parent.
