JSC to investigate Justice Philip Tunoi graft claims

Chief Justice Willy Mutunga has convened a special sitting of the Judiciary Service Commission to probe corruption allegations facing Justice Philip Tunoi.

Dr Mutunga confirmed that he had received an affidavit by one Geoffrey Kiplagat alleging that Justice Philip Tunoi received $2 million (Sh202 million) from Nairobi Governor Dr Evans Kidero to rule in his favour in an election petition filed by Kabete MP Ferdinand Waititu.

“In view of the gravity of the allegations and the public interest the matter has generated, I will be presenting this matter to a special sitting of the JSC that I have summoned for Wednesday,” said Mutunga.

The CJ added that he had tasked the Director of Criminal Investigations to cross-check the truth in Mr Kiplagat’s affidavit, and that he will forward the investigative report to the Director of Public Prosecution and the Ethics and Anti-Corruption Commission for their action.

Mr Kiplagat, a former journalist at Kass FM, detailed in his affidavit how he acted as a bridge between Justice Tunoi and Dr Kidero, leading to the bribe which was to ensure that the Supreme Court upholds the governor’s victory in the 2013 election.
