I shouldn’t be on trial, says Malili accused

A Malili Ranch Ltd director wants his name removed from among the nine people accused in connection with the Sh179 million theft case against a senator and a former permanent secretary over the acquisition of the Konza Techno City land.

Mr Julius Kilonzo Maweu told the court on Monday that he would suffer “double jeopardy since he had been tried and acquitted over the same transaction on July 13, 2011.”

Malili Ranch Ltd sold 5,000 acres to the government at Sh1 billion for the construction of Konza Techno City.

Mr Maweu said in the application filed by lawyers Michael Muchemi Ndegwa and Stephen Andere that the fresh charges against him “are malicious and a fragrant abuse of the criminal justice system. I do not expect any fair trial in view of the foregoing.”

STOP PROSECUTION

Machakos Senator Johnstone Muthama, former Information and Communications PS Bitange Ndemo, former Lands Commissioner Zablon Mabea, commissioner in the National Police Service Commission Ronald Laposo Musengi and Mr Julius Mbau Nzyuko told magistrate Doreen Mulekyo that they would participate in the case filed by Mr Maweu seeking to have his name expunged from the fresh case.

Mr Maweu said he was tried by former Nairobi chief magistrate Gilbert Mutembei and acquitted due to lack of evidence.

He claimed that witnesses in that case would be the same in the current suit.

The trial begins on December 10.
