Kenya Revenue Authority is seeking to have orders stopping it from suspending the licence of a freight station to operate as a bonded cargo handling facility suspended.

KRA wants the order issued on February 1 putting on hold its decision to suspend Autoports Terminals Limited licence dismissed, pending the hearing and determination of the case.

The authority’s application is based on the grounds that the effect of the stay of execution is to allow the company to carry on operations notwithstanding the content of the commissioner of customs and border control’s January 28 letter.

CUSTOMS AREAS

KRA said Autoports did not disclose to the court the letter suspending the operations as a customs bonded cargo handling facility to pave way for investigations into violations of the East African community Customs Management Act.

“The applicant has wilfully neglected to disclose to this court that the commissioner is mandated to regulate customs areas with a view to securing goods or cargo under customs control,” the application read in part.

Through its lawyer Pius Nyaga, KRA also argued that the company, which is associated with Mombasa Governor Ali Hassan Joho, failed to disclose that a January 30 letter from the commissioner persuaded it to resume activities at its premises so as to facilitate clearance of goods.

The application will be heard on February 18.
