Koinange widow to answer murder case

The widow of former Cabinet Minister Mbiyu Koinange has a murder case to answer.

Justice Hellen Omondi Thursday said the prosecution had proved a case against Edda Wanjiru Mbiyu, her stepson David Njuno and five other people in the killing of land rights activist Moses Mpoe and his friend.

Mbiyu, Njuno, Nicholas Ng’etich, Johnstone Sigei, Stephen Mwanga, Sananga Mbukoi and Kiragu Macharia have been charged with murdering Mr Mpoe and Mr Parsaaiya ole Kitu.

The two men died on December 3, 2010 at Soil Junction on the Nakuru-Eldoret highway, when the car they were travelling in was sprayed with bullets.

The State closed its case earlier in the year after calling 17 witnesses, among them one of Koinange’s sons, Mr David Waiganjo, who is also an administrator at the controversial Muthera Farm in Mau Narok.

According to Mr Mpoe, the 4,000 hectare land was community land.

Attempts by defence lawyers to recall Mr Waiganjo to the witness box failed after failing to reach him.

One of Mr Mpoe’s brothers, Mr Joseph Mpoe, who was in the car on the fateful day, was one of the witnesses.

He told the court that he was shot seven times and lost an eye afterwards.

He said he saw a lone gunman on a motorbike aim a gun at them and then opened fire.

Yesterday, the accused told the court that they would tender unsworn evidence when the defence case starts and present four witnesses.

Three of the witnesses are under the Witness Protection Agency.

The case, which has generated a lot of interest, will be heard from September 30 to October 2.
