Dr Lydia Nzomo was on Thursday appointed chairperson of the Teachers Service Commission, ending a protracted recruitment process that has seen the commission operate below capacity for at least two years.
The appointment was announced through a gazette notice, after the High Court declined to block President Uhuru Kenyatta from giving Dr Nzomo the job, as requested by an activist.
Justice Mumbi Ngugi had earlier ruled that the petition by activist Okiya Omtatah was not urgent and did not raise any grave issues to warrant stopping Dr Nzomo’s appointment.
Mr Omtatah had argued that the National Assembly irregularly approved her nomination on Tuesday because she was not among the shortlisted candidates.
“Dr Nzomo’s name was not in the shortlist of the selection panel, and the President’s nomination was therefore illegal, null and void.
“Parliament had no capacity to debate and pass the appointment of a person who was not in the shortlist,” said Mr Omtatah.
Judge Ngugi directed the parties to file their submissions within the next 14 days and scheduled the hearing for December 18.
