Machakos Governor Alfred Mutua in court bid to stop EACC summons

Machakos Governor Alfred Mutua has moved to court to stop summons against him over alleged violation of procurement laws.

Dr Mutua claims the Ethics and Anti-Corruption Commission (EACC) is likely to prefer criminal charges against him in any court, based on an inquiry it had conducted relating to the procurement of motor vehicles.

Through his lawyer, Wilfred Nyamu, Dr Mutua said EACC had insisted on dragging him into the allegations of corruption despite clear legal provisions delinking him and the deputy governor from matters of procurement of goods and purchase of motor vehicles.

RIGHT TO DIGNITY

Lawyer Nyamu stated that the rights to the dignity of Dr Mutua and his deputy are likely to be infringed, as they are likely to be compelled to unjustifiably write statements in relation to alleged violation of procurement law, or get arrested and charged in a court of law with a criminal offence.

“This Act is likely to affect their dignity as the fact of their being associated with the same is likely to be in the public domain hence portraying them in bad light in the eyes of the public, despite there being no connection between them and the allegations,” said Mr Nyamu.

Judge Isaac Lenaola certified the application urgent and directed that the matter be heard Wednesday.
