A man has moved to court to challenge the replacement of Ms Grace Kaindi as the deputy inspector-general of police.

The petitioner, Mr Zachary Onsongo, has filed an application at the Employment and Labour Relations Court alleging that the decision to replace Ms Kaindi violates the Constitution.

Through lawyer Jesse Oduor, Mr Onsongo argues that the transfer erodes constitutional gains towards the empowerment of women.

The petitioner is seeking orders for Ms Kaindi's reinstatement.

The petitioner has sued the National Police Service Commission (NPSC) and the Attorney-General.

Mr Onsongo claims that on August 31, President Uhuru Kenyatta transferred Ms Kaindi from the police service to the Public Service against articles 245 and 246 of the Constitution.

"In effecting the transfer or retire, the President was usurping the powers of the NPSC as enshrined in the Constitution of Kenya 2010," explained Mr Oduor.

The petitioner said the deputy inspector-general of police holds a constitutional office and was appointed on the basis of a competitive process by the NPSC.

"By virtue of constitutional provisions and the National Police Service Act, the deputy Inspector-General cannot be fired without following the due process of the law," he stated.

He added that Ms Kaindi has a five-year contract that ends in 2018.
