Moi’s name to remain in Sh1.6bn case

A judge has declined to strike out former President Moi’s name from a land case.

Lady Justice Pauline Nyamweya said Mr Moi would remain a defendant in the matter until the legal and valid owner of the Sh1.6 billion land in dispute is known.

Dismissing an application by the former Head of State yesterday in which he claimed that he was erroneously included in the case, the judge said the dispute involved double allocation of land and the true owner should be known.

Four traders who filed the case – Mr Simon Kiprono Laboso, Mr Mohammed Nur, Mr Macdonald Lijoodi Makaka and Mr Mohammed Hassan – named Mr Moi, a former Commissioner of Lands, a chief land registrar and Tulip Properties as defendants in the case lodged seven years ago.

The dispute is about ownership of a 16-acre piece of land in Embakasi, Nairobi.

The judge said upon receiving evidence from the traders and Tulip Properties, a company that claims to have bought the land from Mr Moi in 1996, it was clear that all the parties claim ownership. The case will be mentioned on October 8 for further direction.
