Machakos Senator Johnson Muthama moves to court to stop his arrest

Machakos Senator Johnson Muthama has moved to court to stop his arrest.

High Court judge Joseph Onguto has, however, declined to grant temporary orders but certified the application as urgent.

The Director of Public Prosecutions alleges Mr Muthama made remarks during a recent Cord rally at Uhuru Park in Nairobi that are deemed as incitement to violence.

Mr Muthama wants to stop his arrest on the grounds, among others, that Interior Cabinet Secretary Joseph Nkaissery lacks the constitutional mandate to direct the DPP's office on how to perform its mandate.

He has also denied claims he made a statement capable of inciting public to violence.

The case will be heard on Monday.
