A presiding officer in the August 8 General Election has been charged before a Nyeri court for failing to submit result forms.
Mr Patrick Mwangi Ndung’u was charged with failing to submit to the Independent Electoral and Boundaries Commission (IEBC) forms 34A, 35A, 36A, 37A, 38A, 39A, 32, 32A and 42.
The charge sheet indicated that Mr Ndung’u also failed to present the voters’ register and polling station diary to Returning Officer which was in breach of his official duty.
Mr Ndungu was the presiding officer of Nyamachaki polling station 01 in Nyeri town constituency.
ELECTORAL OFFENCES
The prosecution led by Wesley Nyamache told Chief Magistrate Wendy Kagendo that Mr Ndung’u committed the electoral offences on August 9, 2017 at Nyeri National Polytechnic without a reasonable cause.
However, Mr Ndungu denied the charges and the case was postponed to October 23, 2017 when the hearing will begin.
The case came up amid pressure by the National Super Alliance leaders to Director of Public Prosecution Keriako Tobiko urging him to arrest and charge IEBC officials who neglected their duties.
The Opposition coalition outfit said election officials, mainly presiding and returning officers, deliberately refused to relay the accurate results of the presidential election to the National Tallying Centre in Nairobi.
