The mother of an ICC witness missing and presumed dead wants the government to produce him dead or alive after DNA results showed the body lying at an Eldoret mortuary belongs to another man.

Police on Thursday announced that the body lying at the Moi Teachers and Referral Hospital mortuary is that of Hussein Yusuf, a matatu conductor from Nandi County, and not that of Mr Meshack Yebei.

Mr Yebei's mother, Priscillah Yebei, and her family now want the government to produce their son, who has been missing for more than three weeks now.

“All that we want at the moment is our son. We have identified the body at the mortuary and it is ours,” a sobbing Ms Yebei told Nation.co.ke.

DASHED HOPES

Serious Crimes Unit detective John Kariuki, who delivered the DNA report to the family verbally, advised them to get detailed information from Director of Criminal Investigations Ndegwa Muhoro.

“I have the DNA report with me, which I cannot release to the public,” he advised the family at their home in Turbo, Uasin Gishu County.

He dashed the hopes of the family that has laid claim to the body lying at the mortuary, saying: “We can tell that 99.9 per cent of the DNA samples were of Yusuf.”

For their part, Yusuf’s family demanded to be handed the body that was found floating on River Yala early this month for burial.

Mr Abdi Shukri, Hussein’s brother, camped at the mortuary all day Thursday in anticipation of receiving it.

TAKEN SAMPLES

However, Mr Yebei’s family has sued the government and sought to stop the release of the body until their case is heard and determined.

Mr Yebei's wife, Lilian Maiyo, and brothers Moses Kisorio and Ben Yebei on Wednesday filed the case at the Eldoret Law Courts.

Through lawyer Ronald Oyieko, the family has sued Moi Teaching and Referral Hospital, the Director of Public Prosecutions, the Attorney-General and Directorate of Criminal Investigations.

Others are the Registrar of Births and Deaths and the Chief Government Pathologist.

The suit before Eldoret Resident Magistrate Tom Olando will be heard on January 26.

Mr Yebei's kin said they had taken samples to South Africa for independent DNA analysis.

Results are expected out in two weeks, they said.
