Residents in insecurity case ‘disobeyed law’

Turkana residents and the county government have been accused of failing to adhere to a law on dispute resolution in a suit seeking to compel the Interior Cabinet Secretary to protect them against raids.

Responding to a case filed by 20 residents and the regional government, a lawyer for the Attorney-General and Interior CS Joseph Nkaissery said the orders sought in the case were in conflict with the Constitution.

Mr Thande Kuria, for the national government, asked the court to dismiss the case on grounds that the residents and the county government had not complied with the Intergovernmental Relations Act in resolving disputes.

BOUNDARY DISPUTES

Mr Kuria claimed that the orders sought to resolve alleged boundary disputes among Turkana, Baringo, and West Pokot counties were contrary to the law.

“The orders touching on county boundaries should not be entertained. The suing parties have not complied with provisions of the Act in dispute resolution, involving regional and national governments,” said Mr Kuria.
The ruling will be made on Friday next week.
