A businessman has raised integrity concerns against Supreme Court judge Smokin Wanjala and senior counsel Nzamba Kitonga, saying the two applicants shortlisted for the position of Chief Justice are not fit to hold the office.

In his memorandum presented to the Judicial Service Commission (JSC) on Thursday, Mr Abraham Kiplangat Mutai claims that Dr Wanjala failed in his duties during his tenure as deputy director — Research, Policy and Preventive Service — at the now defunct Kenya Anti-Corruption Commission between 2004 and 2009.

He further said there has been massive corruption in the JSC during the tenure of Dr Wanjala as commissioner, chairman and member of the commission’s committees.

He added that there has also been resistance by the JSC to public scrutiny on management, leadership and expenditure of public funds.

Mr Kiplangat also claims that Mr Kitonga, while serving as a commissioner and vice-chairman of the Judicial Commission of Inquiry into the Goldenberg Affair, together with fellow commissioners, ignored a court order in 2004 directing them to summon all those implicated in the scandal.
