Varsity-Moi land saga in court

The United States International University Africa versus former President Daniel arap Moi land saga has moved to court as the private university fights to reclaim the prime property from a US-based private developer, Dr George Kiongera.

USIU-Africa moved to court on Thursday praying that the private developer should be ordered out of the 20-acre piece of land, which he occupied after purchasing it from Mr Moi for Sh500 million last month.

Dr George Kiongera occupies a land in Muthaiga North where the contested property is situated by virtue of owning Maestro Connections Health Systems Ltd, which bought a parcel of land from the former Head of State.

Contacted by the Sunday Nation he said: “I’m a stranger to the matter United States International University has taken to court. I own the piece of land known as 12422/19 which I bought from H.E. Daniel arap Moi last month.

The university is talking about the land known as 12597/2. But because the matter has been addressed to a company I own and by the virtue the matter is in public domain, I have referred it to my lawyers.”

Ndung’u Njoroge and Kwach Advocates for USIU-A wants the court to permanently prevent Dr Kiongera’s company and his agents from “trespassing, entering, invading, developing, constructing, occupying, being present, or in any other manner interfering with the plaintiff’s (USIU) possession, use and enjoyment of parcel 12597/2”.

The detectives have been camping at the Survey of Kenya since last week to establish how the contested land had two different title deeds, survey plans and deed plans.

The fresh details by the Chief Lands Registrar F.K. Orioki paint a picture of duplicity by government officials. While Mr Moi’s title was registered in 1985, USIU-A got its document in 2007.
