Witness’ sister’s body was under bed

A witness Thursday recounted in a Nairobi court that the body of her sister lay under a bed she was unwittingly sleeping in at a rented house.

Ms Nancy Bosibori Mogambi also said that a man charged with her sister’s murder accompanied her to the police station to report the grisly finding before he was later linked to the crime.

The prosecution says that Mr Elly Waga Omondi also raped the former Kenyatta University student before killing her and stashing her body under the bed.

SPENT NIGHT OUT

“I arrived home around 8pm and found the key at the window where we normally kept it; I then opened the door but I did not notice anything unusual...I thought she had gone to see her friends,” Ms Bosibori said.

She said she stayed in the bedroom for a while before getting into bed.

“The following morning, March 26, 2012, I woke up around 7am and my sister had not turned up. I never took it seriously because she at times spent the night out...I locked the main door and placed the key at the window where she could find it,” the witness said.

She then left for college and returned around 3pm.  “I noticed that my sister had not turned up yet, as the clothing she had washed were still on  the line outside.”

Ms Bosibori said she left the house to visit an aunt at the nearby Makongeni estate and returned at 9.30pm but her sister had still not turned up.

“The absence of my sister for such a long time, plus her phone being off, frightened me. Since I was alone I sat on the bed and impulsively decided to check under the bed,” she said.
The witness said she saw her sister’s leg and immediately rushed outside to tell a friend.

“I told him I had seen my sister under the bed,” she said.

The friend, Mr Omondi, is charged with the murder of Ms Ednah Mogambi at Mbotela Teleposta staff quarters, Nairobi, on March 25, 2012.

Ms Bosibori said Mr Omondi accompanied her to Makongeni Police Station to report the matter. The officers later linked him to the murder.

A forensic expert Thursday told the court that Ms Mogambi’s phone was tracked to Mr Omondi’s house.

Mr Livingstone Lihanda said the student’s phone, which had been switched off, was within 100 metres of the scene of crime.
The hearing resumes on March 9, next year.
