Ex-solicitor-general stole my land, claims man

A 73-year-old man has accused former Solicitor-General Wanjuki Muchemi of defrauding him of his land.

Mr Jackson Mwangi Gachura has been fighting to reclaim the land since 1988 but Mr Muchemi has allegedly refused to receive the suit papers.

In his court papers, Mr Gachura says in 1982 he and Mr Muchemi agreed to exchange their parcels of land.

Mr Gachura says he transferred 0.56 hectares to Mr Muchemi while Mr Muchemi was to transfer two parcels measuring a total 10 acres.

They also agreed that Mr Gachura would move to Mr Muchemi’s land after they obtained a consent of exchange and transfer from the Tetu Land Control Board.

Mr Gachura says after the transfer forms were signed, Mr Muchemi refused to transfer his land.

“At the land board, he showed the D.O. the papers and assured him he would hand them over to me,” he says.

Mr Gachura said at the time, Mr Muchemi was an advocate of the High Court and he did not expect him to cheat him out of his land.

“During the same month in 1982, he transferred the land into his name and a title deed  was issued on the same day,” Mr Gachura alleges.

He says Mr Muchemi did not talk to him until 1984 when he received summons from the court where Mr Muchemi had sued him for occupying what he said was his land illegally.

In 1992 the High Court ruled  in favour of Mr Muchemi, disregarding their agreement.

Justice Lucy Waithaka ordered that an advertisement be placed in the national newspapers within 30 days to notify Mr Muchemi of the pending case after which a hearing date would be set.
