Activists sues Nyeri MP over Supreme Court petition

Activist Okiya Omtatah has sued Nyeri MP Ngunjiri Wambugu while seeking an order to bar prosecution of any Supreme Court judges including Chief Justice David Maraga following the September 1 ruling on the presidential election petition.

He wants the legislator barred from attacking the Chief Justice, judges of the Supreme Court or any other judicial officer on decisions made while on duty.

Mr Wambugu filed a petition last week before the Judicial Service Commission, which sought to oust Justice Maraga. President Uhuru Kenyatta asked the MP to drop the petition and the legislator was quoted saying he will not pursue it.

According to Mr Omtatah, the legislator violated rights of the Chief Justice and therefore he should be ordered to pay him Sh10million as compensation.

He argues that the case is a sustained attack on the Chief Justice for nullifying the August 8 presidential election and has far reaching implication regarding the public confidence on the integrity of the judiciary.

He claims that the attack is a well-orchestrated scheme aimed at intimidating judges of the Supreme Court and undermine their independence.

In the case documents, Mr Omtatah accuses members of the Jubilee Party, which Mr Wambugu is a member, to for making offensive statements against the CJ and Supreme Court judges.
