Kakamega Senator Boni Khalwale has claimed that individuals implicated in suspect deals that led to the near-collapse of the Mumias Sugar Company are using courts to frustrate investigations.

He said the Ethics and Anti-Corruption Commission is unable to carry out its work because of the cases.

Dr Khalwale has asked Chief Justice Willy Mutunga to ensure that courts do not protect those suspected to have looted the miller and plunged it into financial doldrums.

“I want to appeal to Dr Mutunga to intervene and ensure judges deliver justice. If those mentioned in corrupt deals use court to block investigations, Kenyans have nowhere else to turn to,” said Dr Khalwale.

The senator has been sued by Nairobi Governor and former Mumias boss Evans Kidero over remarks linking him to the troubled miller.

Dr Khalwale, who spoke at Maturu in Lugari sub-county during the burial of advocate Audrey Omutiko, said he would abide by the court’s order restraining him from defaming the governor.

NO APOLOGY

“I will appear in court on July 15, as directed but I am not ready to apologise for what I said,” the senator told mourners.

Justice Joseph Sergon issued the restraining orders last Wednesday, pending the hearing on July 15.

The matter was certified as urgent and the judge directed that Dr Khalwale be served with the orders.

Dr Kidero had demanded an apology from the senator.

The governor accused Dr Khalwale of defaming him at a presidential function at the Mumias Sports Complex.
