Court declines to cancel George Aladwa's bail

The High Court has declined to cancel bail granted to former Nairobi mayor George Aladwa in an incitement to violence case.

Justice James Wakiaga on Wednesday said Director of Public Prosecutions (DPP) Keriako Tobiko did not provide evidence to warrant the cancellation of bail terms given by Chief Magistrate Daniel Ogembo.

The judge said the accused has a constitutional right to bail.

"The magistrate took all issues into consideration raised when Aladwa was charged and arrived at the decision to grant him bail," said Justice Wakiaga.

He said the DPP has not shown any new development that has taken place since the accused was charged to warrant the cancellation.

The DPP, through Deputy DPP Leonard Maingi, had claimed the politician had continued to engage in hate speech and thus violating the conditions given to him when he was charged.

Mr Aladwa was charged with incitement to violence. He was released on a bond of Sh3 million with an alternative cash bail of Sh500,000.

The case will be heard on May 19.
