Hassan Joho accuses rival of court process abuse

Mombasa Governor Ali Hassan Joho has raised objections to a second suit at the Supreme Court challenging his election.

Mr Joho claimed that his opponent in the last elections, Mr Suleiman Shabhal, was abusing the court process by filing multiple cases even after the Supreme Court dismissed his first case in February.

The governor, through lawyers Dennis Mosota and Paul Buti, argued that Mr Shabahl claimed that his petition was in public interest yet he wanted to achieve a personal agenda of trying to unseat him even after the High Court, Court of Appeal and Supreme Court upheld his March 2013 election.

“The eternal desires and personal endeavours of Mr Shabhal to become governor of Mombasa cannot be a matter of importance however long protracted and much -publicised they are. The dispute has already been resolved and we don’t understand why he is back in court,” said Mosota.

Mr Shabhal, who lost the gubernatorial seat to Mr Joho in a hotly-contested election, has been to court several times seeking the nullification of the election on grounds that it was marred by irregularities and malpractices.

This is the second time he is seeking the intervention of the Supreme Court after his first bid was struck out in February for being filed out of time.
