Interior PS Mutea Iringo defends order on mass action

Interior Principal Secretary Mutea Iringo has defended the order stopping Cord leaders from calling for mass action at their rallies.

Mr Iringo said in a sworn affidavit that Opposition leaders Raila Odinga, Kalonzo Musyoka and Bungoma Senator Moses Wetangula had a history of calling for mass action that resulted in violence.

“Cord leaders have a responsibility to ensure the rights of other people are respected.

MISREPRESENTING FACTS

“The court was justified given the anxiety and tension created by their utterances,” Mr Iringo said.

The PS wants the court to dismiss Cord’s petition seeking to lift the orders obtained by Nairobi Senator Mike Sonko.

He accused the Opposition coalition of misrepresenting facts and “as much as they want to exercise their freedom, they cannot extend it to include propaganda, hate speech and incitement.

“The only way the consent orders can be set aside is by filing a substantive suit in which all elements of coercion, misrepresentation, fraud and collusion can be validly canvassed.”

Mr Justice Isaac Lenaola granted temporary orders suspending the order pending the hearing on Wednesday.
