Jubilee supports grievance against Esther Nyaiyaki

Jubilee Party on Saturday welcomed the complaint seeking prosecution of Supreme Court Registrar Esther Nyaiyaki regarding her report that was used by Supreme Court judges in their presidential election ruling.

"We associate ourselves fully with the petition, which has been filed by lawyer Kioko Kilukumi because it now emerges that the so called unserialised, unsigned and unstamped papers were actually the right forms," Jubilee secretary-general Raphael Tuju said at the party's Nairobi head office.

The complaint was lodged on Friday before the Ethics and Anti-Corruption Commission by Mr Kilukumi on behalf of Mr Rashid Mohammed.

Mr Mohammed demands that those who prepared the Supreme Court Registrar Esther Nyaiyaki’s report be investigated.

REPORT

Mr Mohammed claims that the report used by the majority judges during the presidential poll petition had opposite findings from the one used by judge Njoki Ndung’u, whose gave a dissenting opinion.

"The forms 34B and 34A examined by Justice Ndung’u were certified copies deposited in court by the IEBC within 48 hours of the filing of the petition challenging the presidential election," Mr Mohammed says in the complaint.

CRIME
Mr Tuju said it is a criminal offence if the documents were changed so that what the court relied on for its ruling were falsified documents.

"That is criminal and should be investigated," Mr Tuju said.
