Judgment in case challenging Wambora sacking set for April 16

Judgment in a case in which Mr Martin Wambora is challenging his removal as Embu governor will be delivered on April 16, three judges have ruled.

Sitting at Kerugoya High Court on Tuesday Justices Cecilia Githua, Hedwig Ong’udi and Boaz Olao set the date after the lawyers for Mr Wambora and for the respondents concluded making their submissions.

Mr Wambora moved to court when the Embu County Assembly impeached him over allegations of violating finance and procurement laws.

It forwarded its recommendations to the Senate which then sent him home.

Remove him from office

Mr Wambora argued that a 11-member Senate committee which acted on the County Assembly’s resolutions erred when it made the decision to remove him from office.

Mr Wambora said the committee ousted him even after it received a court order barring it from discussing his matter.

He told the judges that decisions made for his removal by both the County Assembly and the Senate were illegal.

He asked the court to reinstate him.

The former governor submitted that the Senate violated a court order and that its decision should be declared null and void.

He argued that everyone had an obligation to obey court orders and that his removal was a breach of the law.

The embattled Mr Wambora also urged the three judges to interpret the Constitution in a manner that will protect devolution, saying his removal did not meet the constitutional threshold.

Mr Wambora is represented by lawyers Paul Muite, Ahmednassir Abdullahi, Peter Wanyama, David Njoroge and Wilfred Nyamu.
