Moses Kuria tells court Martha Karua fixed DP William Ruto

Gatundu South MP Moses Kuria has told a court that he stands by what he said about Ms Martha Karua's involvement in fixing Deputy President William Ruto at the ICC.

Mr Kuria on Wednesday asked the High Court to dismiss a defamation suit the Narc-Kenya leader has filed against him over the remarks.

The MP told Justice Joseph Sergon that Ms Karua was a senior member of PNU and took part in the negotiations with ODM to "cool down" their supporters during the post-election violence that rocked the country in 2007.

The MP, through lawyer Danson Mungatana, said his remarks at a public rally and later at a press conference at Parliament were meant to remind Kenyans what happened during the PNU and ODM negotiations.

Mr Mungatana said the MP is justified in making the remarks and there is no defamation suit that the court is being asked to issue an injunction for.

"It is true that there were various meetings in PNU to craft the way forward, not restricted to but also included a meeting at Galileo to draft a letter to (the) ICC and also prepare witnesses to support the party," the lawyer said.

Justice Sergon will deliver his ruling on Mr Kuria’s objection to the defamation suit on October 30.

In her suit, Ms Karua states that on September 20, the outspoken MP maliciously uttered statements to the effect that they authored a letter in which they implicated Mr Ruto in crimes against humanity.

Mr Kuria maintains that he and the Narc-Kenya leader procured witnesses to testify against the Deputy President.

He stated in an affidavit that while at the Galileo's nightclub in Westlands they "met to fix DP Ruto by recruiting witnesses to testify at ICC against Ruto".

Ms Karua, through lawyer Gitobu Imanyara, said the offensive words by the MP malign her reputation and portray her as a corrupt and conniving person unworthy of public trust.

"Her reputation stands to suffer if the MP is not restrained from making statements in public," he said.
