A hate speech case facing Gatundu South MP Moses Kuria is yet to be withdrawn in spite of his apology.

Mr Kuria was before the court on Thursday for an appraisal on a proposed reconciliation, which his lawyers said was geared towards an out-of-court settlement.

Prosecutor Evans Maingi said the purpose of the mention was to appraise the court on the reconciliation.

“We have taken steps towards the same and seek a further mention to conclude,” Mr Maingi said.

Parties agreed before presiding magistrate Enock Cherono to return to court on February 17 to confirm the settlement.

The DPP must then formally write to the court informing it of his intention to drop the charges.

Mr Kuria was charged after posting messages on his Facebook page linking one community to the Gikomba terrorist attack which killed several people.

He has since denied charges of incitement to violence, hate speech and fanning ethnic hatred and is out on a Sh5 million bail.
