Muthama should answer to incitement charges, court rules

Barely 24 hours after Machakos Senator Johnson Muthama failed to secure an order to stop his prosecution, a court has issued summons requiring him to answer to charges of incitement and disobedience of the law.

Nairobi chief magistrate Daniel Ogembo issued the summons on Friday following an application by senior deputy director of public prosecutions Leonard Maingi.

Dr Maingi said activist Japheth Muroko alias Japhet Thuranira will face charges alongside the senator.

“The DPP made the decision to charge the two after receiving evidence linking them to incitement” he told the court.

The senator is accused of uttering words in Kiswahili on September 23 at Uhuru Park, Nairobi, that have been translated as those who would go to work before teachers are paid would shall be stoned, allegedly indicating bring death and physical injury.

Muroko faces similar charges. They are both expected in court on October 15 to plead to the charges.
