Tom Odege wins ODM parliamentary nomination for Nyatike

Trade unionist Tom Odege has won the ODM parliamentary ticket for Nyatike constituency in Migori County.

Mr Odege got 14,840 votes against the incumbent Edick Anyangai's 8,083 votes.

There were 90 spoilt votes.

Results from two polling stations, Utuma and Nyatuoro, were nullified because the turnout was more than 100 per cent.

DELAYS

It was a slow start as most polling stations in Karungu and Muhuru were yet to receive voting materials by 10am.

For example, the distribution of ballot boxes and papers in the vast constituency was hampered by the poor road network.

Regarding security, Migori CID Commander Kibirgen Korir said security had been beefed up to contain any acts of lawlessness.

Both Mr Anyanga and Mr Odege had exuded confidence of winning.

ODEGE PETITIONS COURT

Mr Odege will now face Mr Odiso Ogenga, an Independent candidate, Mr Elias Rateng and Mr Olima Obonyo in the August polls.

On June 21, the Court of Appeal ordered the Orange party to conduct a repeat exercise within 48 hours, following a petition by Mr Odege.

Mr Odege had submitted that Justice Luka Kimaru erred in law by taking away the powers of the party to nominate a candidate for Nyatike, and failed to observe that under Section 13(1) of the Elections Act, it is the legal mandate and duty of the party to nominate a candidate.

NEW RULING

That prompted Lady Justice Roseline Nambuye to quash the orders by Judge Kimaru delivered on May 31 that awarded the incumbent the certificate.

"The nomination of Hon Peter Anyanga in the judgement of Justice Luka Kimaru dated and delivered on May 31, 2017 in the Election Petition Appeal No. 89 of 2017, arising from an appeal against the ruling delivered by the Political Parties Disputes Tribunal on May 26, 2017 and judgment of May 9 is hereby set aside," Justice Nambuye ruled.

"The party (ODM) is hereby to conduct the fresh nomination within 48 hours with effect from 4.00 pm today by universal suffrage."
