Boundaries case fails to begin

Hearing of the cases challenging the publishing of the new boundaries failed to begin Tuesday with parties saying they were not served in time.

Businessman John Kimanthi told the court that he needed more time to file responses because he received the papers late.

The cases will be handled by Justice Daniel Musinga, who was appointed by the Chief Justice.

Justice Musinga said he will be completing the cases before the term of the Interim Independent Boundaries Review Commission (IIBRC) expires on Saturday.

The hearing of the case was to begin Tuesday morning according to orders by Chief Justice Evans Gicheru.

According the, businessman's lawyer, Njenga  Mwangi, the petitioner said he needed more time to prepare himself before addressing the court.

But the Ligale team, through lawyer Pheroze Nowrojee, also told the court that they have not yet been served with the application by the petitioner.

Justice Musinga will now hear the case Wednesday and all parties are expected to be ready.

So far, four orders have been issued by Justice Jeanne Gacheche stopping the commission from publishing the 80 new constituencies.
