Suspended Deputy Chief Justice Nancy Baraza on Thursday filed a notice of appeal against a tribunal’s recommendation that she should be sacked.
Ms Baraza filed the notice with the tribunal that found her unfit to continue serving and further recommended her sacking.
The team’s decision would have seen her formally removed from office by President Kibaki within 10 days after the recommendation.
In her appeal, Ms Baraza says she was “dissatisfied” with the decision to kick her out of office and hence the move to seek redress from the highest court in the land.
A member of her defence team who represented her during the hearing, Mr Kioko Kilukumi, said the notice was supposed to be filed with the tribunal, which would then forward it to the court.
The tribunal’s secretary, Mr M. Oguya confirmed on Thursday that he had received the notice and the same filed at the Supreme Court.
“Lady Justice Baraza is dissatisfied with the findings of the tribunal constituted to investigate her conduct and intends to appeal to the Supreme Court,” the notice reads.
On Monday, a tribunal arrived at the recommendation after listening to the DCJ and complainant Rebecca Kerubo, a guard at Village Market, Nairobi.
