The High Court has ordered Mukurwe-ini MP Kabando wa Kabando’s brother, who allegedly killed his mother, be taken to hospital for mental treatment.

Mr Justice James Wakiaga yesterday said Mr Ceasar Thiari, 40, should undergo treatment at Mathari Hospital for one month.

The directive follows a psychiatric report presented before the court by State counsel Njeru Njue.

Mr Njue told the court that mental examination results show that the accused has a history of a chronic psychiatric illness.

“He is not in full control of his mental functions and thus not in a position to appreciate legal proceedings,” said Mr Njue.

The State counsel said that owing to Mr Thiari’s state of health, he could not be assigned a lawyer to represent him in court until he receives medical attention.

The Kabando family supported the proposed treatment of Mr Thiari.

INSENSITIVELY COVERED

However, lawyer Richard Kamotho, for the family, raised concern that the matter was being “insensitively” covered by the media.

He asked the court to protect the accused from such coverage.

“The accused was subjected to media interviews despite the matter being in court. This is distressing to the family members, who are still grieving,” he said.

The request prompted Mr Justice Wakiaga to order journalists to exercise caution when covering the matter.

Mr Thiari is accused of hacking his 70-year-old mother, Rose Wachera Mwangi Kabando, to death at their home in Kaini Village, Mukurwe-ini, on July 27.
