Isiolo court jails for life man who defiled seven-year-old girl

A man was has been sentenced to life in prison for defiling a seven-year-old girl in Nanyuki.

David Murerwa Kirigia was found guilty of defiling the Grade Three pupil on diverse dates in August 2018 in Nanyuki township in Laikipia County.

He was first charged in a Nanyuki court but the case later transferred to Isiolo in order to ensure fairness on the part of the defence.

The prosecution had lined up six witnesses among them the minor, her mother, a clinical officer and police officers.

AUGUST HOLIDAY

The girl’s mother earlier told court that she had taken her daughter to her aunt’s house for the August holiday as she had no house help at the time.

“On August 9, I received a message from my niece that David, who worked at my cousin’s farm, had defiled my daughter,” the mother told the Isiolo court.

“I rushed to my cousin’s place and actually confirmed that my daughter had been defiled. We immediately rushed her to the hospital for examination,” she added.

A medical examination report from the Nanyuki Referral Hospital showed that the girl was defiled for two consecutive days.

UNDRESSED

The court was left in shock when the girl narrated the defiler lured her into a farm behind the house and committed the heinous act on her.

“He on the first day called me to the farm behind the house and undressed me but did not do anything. He told me we were just playing. The following day, he defiled me and warned me against disclosing it to anyone,” the girl said in court.

“I disclosed the issue to my cousin after I begun feeling pain in my genitals.”

In his mitigation, the accused claimed that he had dated the girl’s mother for six years after separating with his wife, and due to some issues, she had threatened to have him arrested.

MARRY MOTHER

“I even promised to marry her but due to some differences, she has decided to frame me,” Kirigia told the court while denying the charges.

In his ruling Chief Magistrate Samuel Mungai said although the girl was a minor, she gave very concise and detailed account of how the accused first attempted to defile her before actualising the act the following day.

“The girl has impressed me as a truthful and reliable witness and on this I am fortified by section 124 of the Evidence Act,” said Mr Mungai.

Mr Mungai said the evidence by the accused lacked truth considering the events that followed after the defilement was discovered.

Kirigia left home in hurry in his working clothes, leaving his food untouched which was clearly the behaviour of a guilty person.

“I am satisfied, after considering the evidence in totality, that the accused defiled the complainant as charged. I dismiss his defence as a pack of lies. The offence is very serious and a deterrent sentence is called for and the accused is sentenced to life imprisonment,” the magistrate ruled.
