High Court dismisses plea by Kakamega man convicted of rape

The High Court in Kakamega has dismissed an appeal by a man sentenced to life imprisonment for defiling a 10-year-old girl.

Mr Reuben Shituli had been convicted after he was found guilty of the offence he committed on February 10, 2012 in Shikumu, Kakamega South.

The prosecution said that the accused, who operates a phone charging business, defiled the girl who had been sent to pick her uncle’s phone from his shop.

TESTIFY

The girl in her testimony, said that Mr Shituli defiled her and gave her two mandazis to buy her silence.

She only opened up to her aunt the next day when she started experiencing intense pain.

Justice Jesse Njagi in his ruling dismissed the appeal and upheld the previous conviction.

The convict in his submissions argued that the magistrate had failed to appreciate the contradiction in the prosecution case.

“On my own analysis, I find the appellant was convicted on credible evidence. The contradictions were minor and could not affect the outcome of the case,” stated Mr Njagi.

Mr Shituli had also made claims of being framed by his political enemies in his submission.

“The accused made general unsubstantial allegations of being framed by his political enemies. He did not identify these people and how they are connected to the case, “added Mr Njagi.
