Vihiga Governor Wilber Ottichilo has filed an application at the Kakamega High Court seeking to stop his impending impeachment by MCAs.
He filed the notice through Maobe Mukhwana and Co Advocates.
In the court papers, Dr Ottichilo has listed County Speaker Hasna Mudeizi, the county assembly and Assembly Clerk Ambaka Kilinga as the first, second and third respondents respectively.
Dr Ottichilo wants the court to issue conservatory orders barring the respondents from commencing impeachment proceedings until his rights are upheld.
He also wants proper service to be effected so that he is granted an opportunity to defend himself against the impeachment grounds laid down by the Vihiga MCAs.
The governor wants the court to certify the matter urgent.
The MCAs are accusing him of abuse of office, imprudent use of public funds, massive sackings of county staff, exaggerating the value of land for the governor's residence and irregular hiring of workers.
Already, 23 out of the 38 MCAs have appended their signatures in support of the impeachment motion as the ouster plan gathers steam.
The assembly clerk confirmed having received the court application.
The matter will be heard on March 5, 2020.
