A 53-year-old man who pleaded guilty to defiling his nine-year-old daughter will spend the rest of his life behind bars, a court has ruled.

Maua principal magistrate Carol Obara ordered that John Muthui be restrained from having any contact with his daughter until she attained 18 years.

The magistrate also directed that the mother takes custody of the child.

Ms Obara termed the act “barbaric and unacceptable”, regretting that cases of defilement were on the rise during Covid-19 pandemic when children were at home.

The accused stood crestfallen when the charges were explained to him in Kimeru language.

“The accused did not offer any mitigation. That alone shows that he is not  remorseful for what he did. I take judicial notice of the rise of sexual offence cases, especially during the current Covid-19 pandemic.

PSYCHIATRIC ASSESSMENT

“Offenders are taking advantage of children who are at home. To deter other would-be offenders, the accused is hereby sentenced to life imprisonment. I also order that he be restrained from having any kind of contact with the child during her minorly life,” ruled Ms Obara.

The court was told how on June 12, 2020, the man found the girl in their kitchen and defiled her.

Her brother heard her crying and upon arrival, found the man defiling the girl.

He raised the alarm attracting members of the public who frogmarched the man to the local Kanuni Police Post.

The girl also reported the matter and was treated at Nyambene sub-county hospital.

The man was first arraigned last week and after he pleaded guilty, Ms Obara suspended the sentencing and ordered that a psychiatric assessment be carried out to ascertain if he was fit to stand trial. The prosecution told court that he was mentally fit.
