Authority warns on 30pc rule

The Transition Authority has warned county governments against ignoring the 30 per cent rule in the hiring of staff saying such appointments would be illegal.

In a letter dated September 2, Transition Authority chairman Kinuthia Wamwangi said any appointments in counties should follow the law and be based on merit, without discrimination.

“Counties are advised to adhere to equality standards and the 30 per cent rule as provided for under section 64, 65 and 66 of the County Government Act when implementing or making decisions on recruitment, transfers and assignments,” he wrote.

Mr Wamwangi said that the warning had been informed by various complaints received by the Office of the Ombudsman also called the Commission on Administrative Justice (CAJ) that county governments were rejecting applicants from other counties or those initially working there.

The CAJ has accused the county governments of ignoring gender balance, advancing tribalism by ignoring the rule that provides for at least 30 per cent of employees should come from outside the counties.

The 30 per cent rule requires that besides at least a third of the employees being of the opposite gender, a third of them should come from other counties.

According to the County Government Act, county public service boards have powers to discipline or hire public officers in counties.
