Ombija to face vetting board, Sharad Rao says

What you need to know:

  • The Board, chaired by Sharad Rao, said it does not recognise Mr Ombija’s resignation letter since it was addressed to it instead of his employer, the Judicial Service Commission (JSC).
  • However, according to the Board, Mr Ombija can appeal for a review of their determination and that complaints raised against him would still be determined by March 31.

The Judges and Magistrates Vetting Board on Thursday said High Court Judge Nicholas Ombija will still be grilled, despite having tendered in his resignation.

The Board, chaired by Sharad Rao, said it does not recognise Mr Ombija’s resignation letter since it was addressed to it instead of his employer, the Judicial Service Commission (JSC).

However, according to the Board, Mr Ombija can appeal for a review of their determination and that complaints raised against him would still be determined by March 31.

The vetting board says one of its regulations requires that a judge who had complaints raised against him has the option of resigning three months after formation of the board but was quick to say that time has since elapsed.

They still consider him a judge and he still has to be vetted.

The judge had voluntarily asked for retirement days ago.
