Gideon Moi wants former Nakuru mayor out of disputed land

Baringo Senator Gideon Moi has moved to court seeking to evict a former Nakuru Town mayor from a parcel of land.

Mr Moi has accused Mr Samuel Towet Kibowen of wrongly occupying the 0.4 hectare land located in Nakuru town’s central business district.

The former civic leader is an ally of his father, former President Daniel arap Moi.

In the matter filed before the Environment and Lands Court in Nakuru, the senator seeks orders to evict and restrain the former mayor from trespassing on the suit property.

VACATE LAND

Through his lawyer Kipkoech Ng’etich, Mr Moi further seeks orders to compel Mr Kibowen to vacate and hand over the land to him.

“Pending the hearing and determination of the suit, I pray that the court be pleased to issue an order of eviction against the defendant,” says Mr Ng’etich.

Mr Moi, who is also the Kanu party chairman, says he is the legal owner of the land which Mr Kibowen has been renting out for business purposes.

In his sworn affidavit, Mr Moi has said he intends to develop the land after he terminated the tenancy of the former mayor in March last year.

“I had given the defendant a two-month notice to terminate the tenancy, but he has refused to vacate the suit property,” reads part of Mr Moi’s court papers.

However, Mr Kibowen has sought to have the case struck out on grounds that it amounts to an abuse of the court process since the matter is being handled by the Business Premises Rent Tribunal.

He says the tribunal had on March 12 issued orders restraining the senator from interfering with his business pending the hearing and determination of the matter.

The hearing will be on July 17.
