  • The governor and his sister Dr Risper Nyagoy had been sued for contempt of court.

The inheritance battle involving members of Kisumu Governor Anyang’ Nyong’o’s family is far from over after the county boss moved to the appellate court to overturn a directive that his nephews be included on the list of beneficiaries.

Prof Nyong’o and his sister Dr Risper Nyagoy, who had been sued for contempt of court, are now seeking to put on hold the execution of the orders issued by the High Court pending the hearing and determination of their appeal.

The High Court had placed one of the governor’s nephews as a co-administrator of a multimillion -shilling estate belonging to their grandfather.

SOLE CONTROLLERS

In her ruling on October 11 last year, Justice Thripsisa Cherere revoked the administrative letters that placed Prof Nyong’o and Dr Nyagoy as the sole controllers of the estate and appointed one of the nephews, Mr Kenneth Okuthe, as a co-administrator of the late Hesbon Shimei Nyong’o’s estate, which is valued at more than Sh200 million.

The properties under contention include 100 acres of land in Miwani and flats on Jogoo Road in Nairobi. Others are parcels of land in Manyatta, Tamu, Milimani estate and East Rata in Seme Sub-County in Kisumu.

According to Mr Jefferson Museve, Prof Nyong’o’s lawyer, the fresh application at the appellate court follows their withdrawal of an earlier one filed at the High Court.

"We feel the appeal has a high chance of success and therefore must be heard before any execution of the orders," Mr Museve said.

FILING A RESPONSE

He added that they will be filing a response to the application made by Mr Okuthe regarding the contempt of court proceedings against the governor and his siblings.

Mr Okuthe wanted the county boss and three of his sisters — Ms Susan Muthune, Ms Esther Nyong’o and Ms Mary Owiti — be jailed for six months for failing to comply with the court order.

In the application that has been certified urgent, Mr Okuthe, through lawyer Rogers Mugumya, wants the court to issue an order compelling the administrators to deposit on a joint interest earning account all proceeds collected from the deceased’s properties pending hearing and determination of the case.

The application will be heard on April 9.
