  • Justice Joel Ngugi directed that the politician should not be apprehended before his application for anticipatory bail is determined.

Former Njoro member of parliament Joseph Kiuna was reprieved on Tuesday by the Nakuru High Court's decision to temporarily bar police from arresting him for incitement.

Justice Joel Ngugi directed that Mr Kiuna should not be apprehended before his application for anticipatory bail is determined.

CONCERNS

Mr Kiuna filed the application under certificate of urgency on Monday and raised concerns about what police intend to do after taking him into custody.

The politician noted that he was surprised when he was informed that more than 40 police officers were looking for him.

He said he was worried that their goal was to detain him just to humiliate or make him suffer.

The public raised concerns following the circulation of footage of Mr Kiuna addressing residents of Likia, where a man was brutally killed last Thursday while tracking stolen sheep.

He is accused of inciting two communities living in the area to turn against each other.

COOPERATION

The former MP recorded a statement on January 10 at the Njoro DCIO after police summoned him.

He said he was ready and willing to face police for investigations as long as his rights are not abused.

Justice Ngugi's directive came after the prosecution requested for more time to respond to Mr Kiuna's application.

He directed that investigations continue and said the case will continue on January 21.
