Court of Appeal Judge GBM Kariuki has accused the police top brass of seeking to sabotage his bid for the post of Chief Justice.

The judge, in an application in the High Court, says Director of Criminal Investigations (DCI) Ndegwa Muhoro and other officers under him have conspired to have him locked out of the race.

He accuses Mr Muhoro of denying him a certificate of good conduct, which is required in applying for the vacancy and which he received in 2011 when he applied for his current job.

The DCI has delayed the release of the certificate in a “malicious and deliberate” move to lock him out of the race, he alleges.

The judge was once tried but acquitted of attempted murder and causing grievous harm after he was charged with stabbing a motorist in Nairobi and instead was awarded Sh5 million for malicious prosecution.

The process of appointing the next Chief Justice is under way and shortlisted candidates are expected to be interviewed from August 29.

Justice Kariuki’s lawsuit was on Wednesday certified urgent and the named respondents, including the DCI, Inspector-General of Police, Attorney-General and Judicial Service Commission (JSC), have been invited for a hearing on August 16.
The judge also seeks orders compelling the JSC to include his name on the shortlist of candidates gearing up for the interviews on August 29 and the police compelled to release the certificate.
