Road rage killer dodges debt, says he is broke

A businessman wanted over a debt of Sh18 million by a family whose breadwinner he shot and killed more than 10 years ago now seeks to be declared bankrupt.

Mr Albert Kubai Mbogori filed the application before the High Court saying he wants to be given a chance to rebuild his life since he has been unable to pay the amount to Mrs Violet Rahedi.

Justice James Makau, however, declined to stay the orders obtained by Mrs Rahedi in February this year, among them a warrant of arrest, for refusing to pay the amount. The judge said he wished to hear from all parties before issuing any orders.

14 MONTHS

Through lawyer Ahmed Jelle, Mrs Rahedi told the court that Mr Mbogori has refused to pay the amount more than seven years since she obtained the judgment. Mr Mbogori shot dead Mr Benjamin Edward Rahedi in a road rage incident on December 1, 2007. Mr Rahedi had just left a club in Ongata Rongai and was shot near the Bomas of Kenya, following a minor accident. He died in hospital three months later.

Mr Mbogori was found guilty of manslaughter and jailed for 14 months. Mrs Rahedi later filed the case seeking damages for loss of dependency and expectation of life. She successfully argued that Mr Mbogori negligently fired the bullet from a gun, leading to her husband’s death.
