What you need to know:

  • The former PS argued that any competent institution should have concluded that there was no offence committed and released them.

  • His co-accused, former ambassador to Libya Anthony Muchiri and former Charge d’Affairs in Tokyo Allan Mburu  said the charges should be dismissed for lack of evidence.

Former Foreign Affairs PS Thuita Mwangi has accused the prosecution of illegally charging him and two other government officials over the purchase of the Kenyan Embassy in Tokyo.

Mr Mwangi submitted that the Director of Public Prosecutions and the Ethics and Anti-Corruption Commission abused their powers in bringing up the charges when several reports had concluded nothing was lost and that the government got value for money.

“The case against us should have never been brought up. The prosecution has not produced an iota of evidence to show the offences we are facing ever took place. One can question the motive of some of the witnesses and wonder if they were not pawns in a high stakes game of chess,” he said.

PROPERTY SELLER

Mr Mwangi said the prosecutor and the EACC disregarded a statement by the property seller, Mr Nabuo Kuriyama, who denied receiving any bribe, a value for money report by the Treasury which concluded no money was lost and the auditor’s report which cleared the transaction.

The former PS argued that any competent institution should have concluded that there was no offence committed and released them.

His co-accused, former ambassador to Libya Anthony Muchiri and former Charge d’Affairs in Tokyo Allan Mburu  said the charges should be dismissed for lack of evidence.

Mr Mburu’s lawyer Kioko Kilukumi submitted that the accused has no case to answer since witnesses evidence was discredited, full of conjecture and inconsistent with the allegations  the DPP made.
