Embu Governor Martin Wambora has suffered a big blow after his application to strike out an election petition filed by former Senator Leny Kivuti challenging his election was dismissed.
While reading his judgement, Justice William Musyoka dismissed the application by Embu governor Martin Wambora saying the court would not rely on evidence outside the court and ought to be presented during trial as part of his evidence.
Musyoka said that Wambora had solely relied on a report that was not properly tabled before the court as evidence contained in the findings on the state of election materials that were to be used as evidence in the case were interfered with by the petitioner.
Through his lawyer Kithinji Marete , Wambora was granted leave to appeal the ruling and asked the court to supply him documents to enable file his appeal while at the same time room to table more evidence to challenge the appeal.
With dismissal of the application by Wambora, the court has set the stage for the petition to kick off.
